Terms of Service

1. Agreement

By using Tocho (tocho.dev), you agree to these terms. If you do not agree, do not use the service. "Tocho", "we", "us" refers to the operator of tocho.dev. "You" refers to the user.

2. The service

Tocho provides AI citation intelligence — analyzing content for its probability of being cited by AI platforms (ChatGPT, Perplexity, Gemini, Claude). We offer:

• Content analysis and scoring (tScore)
• AI-powered optimization suggestions
• Citation prediction and monitoring
• Industry benchmark reports
• Embeddable score badges

Tocho does not guarantee that your content will be cited by any AI platform. Citation behavior depends on factors outside our control, including AI model updates, query context, and competing content.

3. Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account. One person or entity per account — shared accounts are not permitted.

4. Free and paid tiers

Free tier

All users receive 3 free optimization credits upon signup. URL analysis (scoring without optimization) is unlimited and free.

Subscriptions

Paid plans (Pro, Growth, Agency) are billed monthly or annually via Stripe. Prices are displayed in your local currency using Stripe Adaptive Pricing. You may cancel at any time — access continues until the end of the billing period. No refunds for partial periods.

Credit packages

One-time credit purchases do not expire. Credits are non-refundable and non-transferable.

5. Acceptable use

You agree not to:

• Use Tocho to analyze content you do not own or have permission to analyze
• Attempt to reverse-engineer our scoring algorithm or prediction model
• Scrape, crawl, or bulk-access the API beyond your plan limits
• Submit malicious content, scripts, or prompt injection attempts
• Resell access without an agency-tier subscription
• Use the service for any illegal purpose

6. Intellectual property

You retain ownership of all content you submit for analysis. Tocho retains ownership of: the scoring algorithm, prediction model, citation observation data (aggregated), dimension weights, and all Tocho-branded materials.

Optimization suggestions generated by AI are provided for your use — you own the output you create using our suggestions.

7. Data and privacy

Your use of Tocho is also governed by our Privacy Policy. By using the service, you consent to the data practices described therein.

8. API and developer access

API access is available on Agency plans. API keys are confidential — do not share them publicly. We reserve the right to revoke API access for abuse. Rate limits apply per your plan tier.

9. White-label and reseller

Agency-tier subscribers may white-label Tocho reports for their clients. The underlying Tocho branding ("Powered by Tocho") must remain on embeddable badges and widgets unless explicitly agreed otherwise in writing.

10. Limitation of liability

Tocho is provided "as is" without warranty of any kind. We are not liable for: changes in AI citation behavior, lost revenue from content not being cited, downtime, or data loss beyond our reasonable control. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted per our Privacy Policy.

12. Changes

We may update these terms. Material changes will be communicated via email 30 days before taking effect. Continued use after changes constitutes acceptance.

13. Governing law

These terms are governed by the laws of the Province of Quebec, Canada. Disputes will be resolved in the courts of Montreal, Quebec.
